Legislation

Following is some of the proposed State legislation related to solid waste and the environment:

A09239 – Requires paint manufacturers to establish paint stewardship programs, to develop and implement strategies for reducing the generation of post-consumer paint, to promote the re-use of post-consumer paint, and to collect, transport and process post consumer paint for the end of product management 

A06813/S03593 – Provides for the recycling of rechargeable batteries and prohibits disposal of them as solid waste 

A10845 – Requires the commissioner of general services to implement a recycling program for all state-owned and state-leased properties 

S01108 – Requires the placement of one recycling receptacle for drink containers for every four waste receptacles on state owned property 

A01653 – Requires motor vehicle manufacturers to establish programs for the collection and recycling of mercury-added components from their vehicles 

A05470 – Provides that fairs, shopping centers and amusement parks shall provide recycling containers and participate in available recycling 

A03240 – Authorizes the taking of title to solid waste by municipalities 

A01931 – Requires drivers to come to a full stop upon approaching and prior to passing a sanitation vehicle stopped for the purpose of picking up refuse 

Legislation Passed in 2010 

Electronic Equipment Recycling and Reuse Act -Effective April 1, 2011 and requires:

·         Manufacturers of “covered” (computers, TVs, monitors, peripherals, scanners, fax machines, cable boxes, game consoles, mice, printers, copiers) equipment to take responsibility for its disposal

·         Sellers to take back equipment and are likely to partner with recyclers

·         Manufacturers to register with DEC before January of 2011

·         Manufacturers to provide 3 years of sales data and the names their products are sold under

·         Manufacturers to pay a registration fee

·         Recyclers to register

·         Manufacturers to report the amount recovered and must pay $3,000 to do so

·         Goals are set for recovery based on the volume sold

·         Standards to be created for each company; companies will be fined if they are not met
